Even with spaces, it treats my pointy brackets with exclamations mark and double hyphens, followed by a double hyphen, pointy bracket, as a comment!

Andy - I did read the T&Cs just to check what the position was. I reached the same conclusion as you - if I was using the API, I'm free to do what I like with the images.

I didn't use the API, though, I just copied and pasted!

However, I would say that my use of the image was covered by the UK's fair dealing provisions on copyright.

Having said all that, I couldn't be bothered to have a fight so I took it down

Actually, Paula, seeing as you have a publicly available Twitter profile, and have uploaded a photo to said profile whilst agreeing to the following terms and conditions, anyone can "use"/reference your photos:

"Twitter has an evolving set of rules for how API developers can interact with your content. These rules exist to enable an open ecosystem with your rights in mind."

Under those rules (http://dev.twitter.com/pages/api_terms), 1.d reads:

"Respect the privacy and sharing settings of Twitter Content."

Your picture was publicly available and therefore shared, ergo your privacy and sharing settings have been respected.

It seems obvious now I have read it but I hadn't thought about my avatar so much before.

I use a cartoon of myself that I created ages ago but think I need something a little bolder and simpler.

Another point to note perhaps is not to use other peoples trademarks no matter how much you like them or how ironic you think they are.
